Patient records sought in Kan. abortion case

A legal fight for women's medical records is now brewing in the criminal case of the man accused of killing Kansas abortion provider Dr. George Tiller.

Tiller was shot to death last May 31 at his Wichita church. Lawyers for suspect Scott Roeder have subpoenaed Tiller's calendars, schedule of procedures and other documents for all of May and June.

A lawyer for Tiller's widow filed a motion Monday to quash the defense subpoena.

Attorney Lee Thompson argues the records contain confidential medical information that would take weeks to redact. Thompson also says none of the records show any scheduled procedures on the Sunday that Tiller was killed.

Jury selection for Roeder's trial on a charge of first-degree murder is set to begin Wednesday.
