Roeder judge must rethink ruling on media in trial

The Kansas Supreme Court on Tuesday night ordered a judge to reconsider his decision to close jury selection and seal a blank questionnaire in the Scott Roeder murder trial.

The high court ruled that Sedgwick County District Judge Warren Wilbert did not follow proper legal procedure before keeping the public out of court. The opinion, by Chief Justice Robert Davis, said Wilbert must balance "the defendant's right to a fair trial with the public's and media's rights to access judicial proceedings."

The Eagle, the Kansas City Star, the Associated Press and KWCH-TV had asked the Supreme Court to intervene after Wilbert ordered jury selection closed to the public.

Wilbert has asked attorneys for the parties and the news organizations to meet with him at 8 a.m. today to discuss ways to resolve the dispute and not delay the trial.

Jury selection was scheduled for 9 a.m.
